    TERMS AND CONDITIONS FOR THE SAMSUNG GALAXY

    Please read this Promotion terms and conditions (“Terms and Conditions”) carefully. Participation in this Promotion will constitute your agreement to comply with these Terms and Conditions. If you do not agree with these Terms and Conditions, please do not participate in this Promotion. This Promotion is only available while Stock lasts.     All participants during the term of this Promotion agree to be bound by the following Terms and Conditions:

    1. Promotion:

    • Samsung Galaxy A12 (SM-A125FZ) and Absa Cash Send Voucher (“Promotion”).
    • The promoter of the Promotion is Samsung Electronics South Africa (Proprietary) Limited, Registration number: 1994/003872/07 and/or its agencies ("Organiser").

    2. Promotion Period:

    • The Promotion will run from Thursday 21st January 2021 [00h00] to Sunday the 28th February 2021 [23h59] (“the Promotion Period”), in South Africa.
    • The participant will have from Thursday 21st January 2021 [00h00] to Sunday 7th March 2021 [23h59] to enter and register via the Samsung WhatsApp application.
    • The duration of the Promotion may be extended or curtailed at the discretion of the Organizer.
    • The promotion is valid for the first 12,000 (Twelve Thousand) redeeming customers.
    • The Organizer cannot be held accountable once the 12,000 (Twelve Thousand) redemptions for the promotional Offer or Qualifying Product has been depleted.

    3. Who may enter:

    • All participants must:
      1. be citizens of the Republic of South Africa and/or legal residents of the aforesaid country;
      2. be currently residing in the Republic of South Africa at the date of the commencement of the Promotion Period;
      3. be a natural person and be at least eighteen (18) years old at the date of the commencement of the Promotion Period;
      4. made a valid purchase of a Samsung A12 device, with a valid IMEI number, purchased within the Republic of South Africa from any authorised network provider, a retail outlet or online.
    • Participation in this Promotion includes the Organiser, their directors, members, partners, employees, agents, consultants, any other person who directly or indirectly controls or is controlled by them or any supplier of goods and services in connection with the Promotion and their spouses, life partners, parents, children, siblings, business partners or associates, provided the following is adhered to:
      1. The participant must have personally purchased a Samsung A12 for themselves. Proof of purchase can be verified at the Promoter’s discretion.
      2. Misrepresentation of customers by instore sales representatives will result in the disqualification of the claim.

    4. How to qualify for the Promotion:

    • the participant must:
      1. Purchase a Samsung Galaxy A12 device from any authorised network operator, a retail outlet or online, during the Promotion Period;
      2. Be one of the first 12,000 (Twelve Thousand) redeeming customers within the redemption period;
      3. Keep the electronic slip or invoice as proof of purchase;
      4. Participant saves the WhatsApp number 0870562158 to their phone and sends their new device IMEI number to the number in a WhatsApp message to enter.
      5. Consumer will be prompted through the WhatsApp entry process and will be required to provide:
        • Provide personal details – email address, Name, Surname, ID Number
        • Purchase details – Date of purchase, photo of Proof of purchase (Till Slip)
      6. Participants entry will then be verified (3 business day turn-around)
      7. Once successfully verified, consumer will receive their R200 Absa Cash Send Voucher via SMS.
    • . Claims to redeem the R200 Absa cash send voucher in respect of the device purchased during the Promotion Period and/or Redemption Period will not be accepted or processed after the 7th March 2021 (23h59).
    • Proof of purchase must be provided during the entry process. Sending an incorrect image will disqualify the participant from to the Promotion.
    • The R200 Absa cash voucher is valid for 30 days to redeem. If the R200 Absa cash voucher is not withdrawn within 30 days of receiving the unique voucher code and details, the customer will forfeit the voucher.
    • In the event that the customer receives no response to their entry, the participant is required to contact the Organiser on 0870562158 on or before close of business on the 7 March 2021 and provide proof of entry prior to the promotion redemption end date.
      1. If the participant does not follow this process and does not receive a response, their entry will not be considered.
      2. If the Organiser has not received this request, the Organiser will assume that the participant has received a response.
      3. Any participant who has unsubscribed from receiving marketing SMSs will not receive the SMS and it is the participant’s responsibility to notify the Organiser. The Organiser cannot be held responsible for SMSs not received by participants.

    5. Can I qualify more than once for the Promotion:

    • The Promotion is limited to one (1) R200 Absa cash send voucher per valid device purchased (identifiable by the unique IMEI numbers).
    • Should there be any dispute in this regard, the Organizer shall be sole adjudicator of the dispute and the Organiser’s decision shall be final.

    6. Offer:

    • The Promotion will afford the participant the opportunity to receive one R200 Absa cash send voucher per a Samsung Galaxy A12 device.
    • The R200 Absa cash send voucher is not transferable. No substitution, or assignment of the R200 Absa cash back voucher is permitted.
    • The R200 Absa cash send voucher may differ from that shown on the promotional material with regard to colour and specs and same shall be subject to availability and in the Organiser’s sole discretion to select same.
    • Absa Cash Send is governed by the following terms and conditions:
      1. Qualifying Participants will be sent an ABSA branded SMS with a 10 digit pin code.
      2. The qualifying participant will then also receive a second SMS with a 6 digit code and the value of the prize.
      3. To claim the cash prize, participants will need to go to an ABSA ATM (ABSA Cash Expresses and other banks and their ATMs are not included).
      4. At the ABSA ATM the participant will need to choose the Cash Send option on the screen, enter in the 10 digit code found in the first SMS and click proceed/ continue/ enter.
      5. Then enter the 6 digit code pin code found in the second SMS and click proceed/ continue/ enter.
      6. After entering the full value of the prize at the ATM, the ATM will give you your money with a receipt.
      7. If the participant does not withdraw the full amount, they will forfeit the rest of their prize.
      8. The Cash Send must be redeemed within 30 days of receiving the ABSA Cash Send SMS’s. If the Cash Send is not claimed within 30 days of receiving the ABSA Cash Send SMS’s, the participant will forfeit their prize.
      9. Only one redemption per 10 digit is allowed. If the full amount of the Cash Send is not claimed in the first withdrawal, the remaining value will be forfeited.
      10. For any problems in redeeming the cash prize at the ATM, the winner can call the ABSA helpline on 0860 111 123.
      11. If for any reason the ABSA ATM does not have relevant cash notes available, the participant will have to try another ABSA ATM to withdrawal the cash prize.

    7. Terms of Offer Redemption:

    • Upon migrating/ purchasing a participating Samsung Device within the Promotional Period, participant saves the WhatsApp number 0870562158 to their phone and sends their new device IMEI number to the number in a WhatsApp message to enter. Consumer will be prompted through the WhatsApp entry process providing Personal and Purchase details as outlined in clause 4.
    • The Participant’s submission will be verified, and valid entries will receive an ABSA branded SMS, within 3 business days, with a 10-digit pin code.
    • In the event that no SMS is received, the participant is required to contact the Organizer no later than the 7th March 2021 only on 0870562158.
    • If the participant does not follow this process and does not receive an SMS, the participant will not be entitled to the Offer. Any participant who has unsubscribed from receiving marketing SMS’s may not receive the SMS and it is the participant’s responsibility to notify the Organizer. The Organizer cannot be held responsible for SMS’s not received by participants.
    • The verification period will take 3 (three) working days from the date that the participant correctly completes their entry.
    • Once the entry has been verified, the participant will receive their Absa Cash Send via SMS & can then draw their cash from ABSA ATM.
    • The Offer is not transferable. No substitution, cash redemption, or assignment of the Offer is permitted.
    • This Offer is provided at the sole discretion of the Organizers.
    • Deliveries of SMS’s will occur from Monday to Friday during regular office hours (08h00 to 17h00) and no deliveries of SMS’s will be made on public holidays or over the weekends.
    • In the event that the participant fails to withdraw the R200 Absa cash back voucher within thirty (30) days, the R200 Absa cash back voucher shall be forfeited.
    • The participant must present a valid pin to claim the R200 Absa cash back voucher, the pin is provided in the final SMS delivering the R200 Absa cash back voucher.

    8. Limitation of Liability:

    • To the extent permitted by Consumer Protection Act No 68 of 2008 and any other applicable law:
      1. The participant and/or participant(s) hereby indemnifies the Organiser against any direct, indirect, special, incidental, consequential or punitive damages or loss of any kind regardless of how this was caused, and whether it arose under the law of contract or delict or otherwise, because of the participants entrance to the Promotion.
      2. The Organiser excludes all warranties (express or implied), representations and liabilities regarding this Promotion (other than for death or personal injury caused by its negligence and/or fraud).
      3. All personal information exchanged with the usage of third party applications will not be monitored or controlled by the Organiser. The participant bares the responsibility to ensure that it is aware of the terms and conditions applicable to usage of 3rd party applications. The participant understands and agrees to indemnify the Organiser from all liability arising from whatsoever nature.

    9. General:

    • In accordance with the confidentiality policies and practices of the Organiser, none of the entry details of any participant in this Promotion will be disclosed or used by the Organiser for any purposes other than for entry into the Promotion and in accordance with clause 9.7 below.
    • The Organiser reserves the right, at any time, to verify the validity of participants (including a participant’s identity and place of residence) and to reject any participant who has not agreed to these Terms and Conditions. Errors and omission may be accepted at the Organiser's discretion. Failure by the Organiser to enforce any of its rights at any stage does not constitute a waiver of those rights.
    • If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Organiser, including but not limited to technical difficulties, unauthorized intervention or fraud, the Organiser reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any participant; or (b) to modify, suspend, terminate or cancel the Promotion as appropriate, subject to the approval of relevant regulatory authorities.
    • Data charges may be incurred for entry on the WhatsApp line provided. Network rates apply.
    • Participants acknowledge and accept that the Organiser shall utilise a third party agent to deliver the R200 Absa cash voucher to qualifying participants. In order to affect the contacting and delivery process, the Organiser shall provide the participant’s information to such third party agent.
    • Details of participants will not be used by the Organiser for Samsung related communication should the participants opt-out to receive further communication from the Organizer.
    • Information regarding the Promotion that is published on authorized advertising material will also form part of the Terms and Conditions of the Promotion.
    • The Organiser may in its sole discretion amend these Terms and Conditions at any time, without notice, and such amendments shall be deemed to have taken effect from the date of publication of the revised Terms and Conditions on the Organiser’s website https://www.samsung.com/za/offer/The onus rests on the participant to constantly check the website for updates to the Terms and Conditions.
    • The Organiser reserves the right, at any time, to verify the validity of participants (including a participant’s identity, age and place of residence) and to reject any participant who has not agreed to these Terms and Conditions. Errors and omission may be accepted at the Organiser's discretion. Failure by the Organiser to enforce any of its rights at any stage does not constitute a waiver of those rights.
    • If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Organiser, including but not limited to technical difficulties, unauthorized intervention or fraud, the Organiser reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any participant; or (b) to modify, suspend, terminate or cancel the Promotion as appropriate, subject to the approval of relevant regulatory authorities.
    • Save as permitted by law, the Organiser reserves the right to cancel, suspend or terminate this Promotion, without notice at any time, and such cancellation, suspension or termination shall be deemed to have taken effect from the date of publication on the Organiser’s website https://www.samsung.com/za/offer/ liability shall lie against the Organiser in favour of any participant, winner(s) and/ or third party arising from such cancellation, suspension or termination. Therefore the participant waives his/her right which they may have against the Organiser and hereby acknowledge that they will have no right of recourse or claim of any nature whatsoever against the Organiser.
    • This Promotion is governed by these Terms and Conditions, as well as those of the relevant authorized participating stores, associated with this Promotion.
    • Any dispute or claim arising out of or in connection with the Promotion shall be governed by and construed in accordance with the laws of South Africa.
    • To the extent that these Terms and Conditions conflict with the terms and conditions of Samsung Members application, these Terms and Conditions will take precedence.
    • The Organiser accepts no liability or responsibility, whether occasioned by any circumstance not foreseeable and not within its reasonable control for late or delayed delivery of the R200 Absa cash back voucher owing to, but not limited to, stock unavailability, strike, lock out, any civil commotion or disorder, riot, threat of war, any action taken by governmental authority or public authority of any kind, fire, explosion, storm, flood, earth quake or other acts of God.
    • If part or all of any clause of these Terms and Conditions is illegal, invalid or unenforceable:
      1. It will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible; and
      2. It will be severed from these Terms and Conditions and the remaining provisions of these Terms and Conditions will continue to have full force and effect.

    10. Consumer Protection Act:

    • To the extent that the Terms and Conditions or any goods or services provided under the Terms and Conditions are governed by the Consumer Protection Act, 2008 (the "Consumer Protection Act"), no provision of the Terms and Conditions are intended to contravene the applicable provisions of the Consumer Protection Act, and therefore all provisions of the Terms and Conditions must be treated as being qualified, to the extent necessary, to ensure that the applicable provisions of the Consumer Protection Act are complied with.
